Rush Tracker End-User License Agreement

01 / This agreement

This End-User License Agreement ("EULA") is a legal agreement between you and Rush Live, Inc. ("Rush Live", "we", "us") for Rush Tracker, our Windows desktop app distributed through Overwolf (the "App"). By installing or using the App you agree to this EULA. If you do not agree, do not install or use the App.

02 / What Rush Tracker is

Rush Tracker is the match-verification companion for the Rush app; it is the Companion described in the Rush Terms. Once you link your PC to your Rush account, it reads the game events Overwolf provides for supported games (currently Rocket League, Rainbow Six Siege and Fortnite) and sends a signed summary of your own matches to Rush so they can be verified. It is read-only: it has no in-game overlay and never changes your game, reads game memory or sends input. It has no wallet, payment or betting features; everything involving your Rush account happens in the Rush app.

03 / The Rush Terms cover everything else

Your Rush account, and everything you do on Rush, are governed by the Rush Live, Inc. Terms of Service at join-rush.com/terms (the "Rush Terms"), the Rush Privacy Policy at join-rush.com/privacy, and any rules published for a contest. That includes eligibility (including the minimum age), contests, payments and payouts, acceptable use, account suspension, disclaimers, limitation of liability, indemnification, dispute resolution (including binding arbitration and the class-action waiver) and governing law.

The Rush Terms also apply to your use of the App. If this EULA and the Rush Terms conflict about the App itself, this EULA controls; on everything else, the Rush Terms control.

04 / Your license

Subject to this EULA, Rush Live, Inc. grants you a limited, non-exclusive, revocable, non-transferable, non-sublicensable, worldwide license to use the App solely for your personal, non-commercial use, through the Overwolf platform and in line with Overwolf's terms. We keep all rights not expressly granted.

05 / What you may not do

• Change, tamper with or interfere with the App, its signing, or the match reports it sends, or use it to report a match that did not happen as reported.
• Copy, sell, rent, sublicense or distribute the App, or use it for any commercial purpose.
• Reverse engineer, decompile or disassemble the App, except where the law allows it despite this restriction.
• Use the App in a way that breaks Overwolf's terms, a game publisher's terms, or the Rush Terms.

06 / Overwolf

This EULA is concluded between you and Rush Live, Inc. only, not with Overwolf. Rush Live, Inc., not Overwolf, is solely responsible for the App and its content.

You and we acknowledge and agree that Overwolf and Overwolf's subsidiaries are third-party beneficiaries of this EULA, and that, once you accept this EULA, Overwolf will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary. Overwolf is not responsible for, and has no liability whatsoever under, this EULA or any other end-user agreement for the App.

07 / Intellectual property claims

If anyone claims that the App, or your having or using it, infringes their intellectual property rights, Rush Live, Inc., not Overwolf, is solely responsible for investigating, defending, settling and discharging that claim.

08 / Maintenance and support

Rush Live, Inc. is solely responsible for any maintenance and support of the App, as described at join-rush.com/tracker/support or as required by law. Overwolf has no obligation whatsoever to provide maintenance or support services for the App.

09 / Use at your own risk

Your use of the App is at your own risk. The App is provided "as is" and "as available". To the fullest extent the law allows, Rush Live, Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not promise that the App will be uninterrupted or error-free, or that every match will be captured or verified.

Rush Live, Inc., not Overwolf, is responsible for any warranty, express or implied by law, to the extent it is not effectively disclaimed. The disclaimers and limitation of liability in the Rush Terms also apply to the App.

10 / Third-party sites and services

The App relies on Overwolf and works with games and websites that belong to other companies. We have no control over third-party sites or services and are not responsible for the content or services available through them, and we do not endorse any products or services they offer. Your use of third-party sites and services is at your own risk, and we encourage you to use caution with them. You must comply with any third-party terms that apply when you use the App, including Overwolf's terms and each game publisher's terms.

11 / Contests

Every contest on Rush is offered solely by Rush Live, Inc., under the Rush Terms. Overwolf is not a sponsor of, and is not affiliated with, any of them.

12 / Your data

What the App collects and why is in the Rush Tracker Privacy Notice at join-rush.com/tracker/privacy. Everything else about how Rush Live, Inc. handles personal data is in the Rush Privacy Policy at join-rush.com/privacy.

13 / Ending this EULA

You can stop at any time: unlink your PC in the App's Settings and uninstall it. We may suspend or end your license if you break this EULA or the Rush Terms, or if we stop offering the App; when it ends, you must stop using the App. The sections "The Rush Terms cover everything else" through "Your data" survive. A few files stay on your PC after you uninstall, so that a reinstall stays linked; the Rush Tracker Privacy Notice explains how to remove them.

14 / Changes

We may update this EULA. We will change the dates at the top and, for material changes, tell you in the App or the Rush app before they take effect. If you keep using the App after a change takes effect, you accept the updated EULA.

15 / Trademarks

Rocket League, Rainbow Six Siege, Fortnite and Overwolf are trademarks of their respective owners. Rush Tracker is not affiliated with, sponsored by or endorsed by them.
