01 / Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and Rush Live, Inc. ("Rush Live", "Rush", "we", "us") covering the Rush Live mobile application, the Rush Live companion software for your PC, and the services offered through them (together, the "App"). In these Terms, "Companion", also written "companion", means the Rush Live companion software for your PC, which is called "Rush Tracker" in the App. By creating an account or using the App you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

You accept these Terms by tapping "I agree" at the end of sign-up and by continuing to use the App. We record the date, time and version of the Terms you accepted, and that record is our evidence of the agreement between us. When we make a material change we will ask you to accept the new version before you continue.

02 / Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated through the App or by email at least 30 days before they take effect, and the "Last updated" date at the top of this document will change.

Your continued use of Rush Live after the effective date of a modification constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App; you may withdraw any winnings and request a refund of any unused deposit balance as described in the Wallet section.

03 / Eligibility

To use Rush Live, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction, if higher)
  • Be a legal resident of, and physically located in, the United States
  • Have the legal capacity to enter into these Terms
  • Not reside in a state where the skill-contest lanes are unavailable (see Geographic Restrictions)
  • Not be an employee, contractor, or immediate family member of Rush Live or its affiliates
  • Not be a person with whom U.S. law prohibits us from doing business

Rush Live is an 18+ application: every contest in the App is played for real money, and there is no under-18 or free-currency mode. By using the App you represent that you meet every requirement above. It is your responsibility to make sure your use of the App is lawful where you are.

We may verify your age, identity and state of residence at any time — before your first real-money entry, and again whenever we consider it necessary for fraud or legal reasons — through government-issued identification, our identity-verification provider, or other reasonable methods, and we may suspend real-money activity on your account until verification is complete.

04 / What Rush Live Is

Rush Live is a contest of skill, not a sportsbook, casino, or sweepstakes.

Rush Live lets you compete for real money on your own verified gameplay. The Rush Live companion, installed on your PC, reads your own game client and reports the result; there is no video, no stream, and nothing to watch. Everything in the App is one of two things: (1) player-versus-player skill contests for real money between partnered players — head-to-head 1v1 and team formats of 2v2, 3v3 and 4v4; and (2) self-stake fixed-multiplier skill contests for real money, in which you compete against a target rather than another player.

Every contest in the App is played for real money. Rush Live does not operate a free-to-play mode, a virtual or promotional currency, a sweepstakes, or any prize draw. There is no currency that can be purchased, and no currency that converts into money.

Rush Live is the venue. On the player-versus-player lanes, Rush never sets a line or takes the other side — it charges only a flat fee out of a pot funded entirely by the players. Self-stake is a contest of skill in which Rush funds a fixed, pre-announced prize set before you enter. Rush is never a bookmaker and never accepts wagers against a player.

05 / Your Account and Its Security

  • One person, one account. You may not create or operate more than one Rush Live account, and you may not open an account for anyone else
  • Your account is personal to you. You may not sell, lend, share, or transfer it, and you may not let anyone else play, verify, deposit, or cash out on it
  • You are responsible for everything that happens on your account. Keep your sign-in codes and your device secure, and tell us at once if you believe someone else has used your account
  • The name on your account, on your verified identity document, and on any card or payout destination you use must all be yours and must match. We may hold or refuse a deposit, entry, or withdrawal when they do not
  • You must give us accurate information at sign-up and keep it current

We may refuse to open an account, or close one, for anyone who does not meet these requirements. Money you are entitled to is returned as described in the Wallet section when an account is closed, subject to the reviews described in these Terms.

06 / Identity Verification (KYC)

To protect against fraud and to comply with applicable law, identity verification is required before your first real-money entry — that is, before your first deposit, contest entry, or withdrawal — and again if we require it for fraud or legal reasons.

  • Identity verification (KYC) is performed through Stripe Identity, which checks a government-issued ID and a selfie
  • You must be 18 or older and may be asked to confirm your identity, age, and state of residence
  • Where biometric verification is used, separate consent will be requested before any biometric data is collected
  • We may withhold a deposit, entry, or payout pending verification, review, or resolution of a suspected violation
  • Self-exclusion and responsible-gaming limits are available in the App; if you self-exclude, you may not enter the real-money lanes

07 / USD Wallet, Deposits and Refunds

Real money moves through a segregated USD wallet held in cents on our servers. Funds are organized in buckets:

  • Deposit bucket: funds you add by card. Deposits pay contest entry fees; an unused deposit balance can be refunded, but only back to the card it came from
  • Winnings bucket: amounts you win from contests. Winnings are withdrawable, subject to identity verification and applicable law
  • Deposits, refunds and withdrawals are processed by Stripe; Rush Live does not store your full card or bank details
  • There is no PayPal/Venmo cash-out and no user-to-user transfer of funds
  • Your wallet balances are held for your benefit in a segregated custodial account, separate from Rush's operating funds — Rush holds them as custodian/agent for you, not as its own assets
  • Rush's operating money and the self-stake prize fund are kept separate and are never funded out of user deposits

Every entry fee, contest payout, and balance change is moved server-side. You never move money directly to or from another user; Rush holds entry fees in escrow and pays the winner.

Refunding an unused deposit

You may ask, in the App, for your unused deposit balance to be returned. A deposit refund goes back only to the card (or cards) the money arrived on, through a Stripe refund — never to a bank account, a different card, or another person. That is what keeps it a refund of a purchase rather than a withdrawal. The refundable amount is the smaller of your spendable deposit balance and what the original card payments can still accept; money already committed to an open contest is not refundable until that contest settles.

Chargebacks and payment disputes

If you dispute a deposit with your card issuer instead of asking us for a refund, the disputed amount is removed from your wallet as soon as we are notified, and we may freeze real-money activity on your account while the dispute is open. If the dispute closes in our favour, the amount is restored. A dispute filed on a deposit you actually made and used is treated as fraud under the Fair Play section. Contact us first — a genuine error is corrected faster through us than through a dispute.

When money becomes available

  • Your entry fee leaves the deposit bucket the moment you enter a contest and is held in escrow until the contest settles
  • Winnings are credited to the winnings bucket when the contest settles from verified game data — normally within minutes of the match ending, longer if the result is under review
  • You may request a withdrawal from the winnings bucket at any time after settlement; withdrawals are paid through Stripe and may be held for the reviews described in Settlement and in Monitoring, Enforcement and Termination

08 / Withdrawals

  • Only the winnings bucket can be withdrawn; deposits are refunded to the original card instead (see above)
  • Withdrawals are paid through Stripe Connect to a payout destination in your own name. We do not pay out to a third party
  • Your account must be identity-verified, and the name on the payout destination must match your verified identity
  • We do not charge a fee to withdraw. Your bank or card issuer may
  • Withdrawals are normally paid within one to three business days of approval, but we may hold a withdrawal while a contest that funded it is under review, while an investigation under these Terms is open, or where the law requires it
  • We may require a valid taxpayer identification number before a reportable amount is released (see Taxes)

09 / Fees

  • Player-versus-player contests: a flat venue fee — currently 5% of the pot, which is 10% of each player’s ante — taken from the pot when the contest settles. The exact fee for a contest is a fixed percentage shown to you before you enter, never a margin built into a price
  • Self-stake contests: there is no separate fee. Rush earns the difference between the fixed multiple it announces and the likelihood, priced from your own verified statistics, that you reach the target
  • Deposits, deposit refunds and withdrawals: no fee from Rush
  • Membership, when it is available: the subscription price shown in the App at purchase (see Membership)
  • We do not charge inactivity, maintenance, or account-closure fees

Any fee is shown to you before you confirm the action it applies to. A fee frozen on a contest at entry is never re-priced while that contest is open.

10 / Player-Versus-Player Skill Contests (1v1 and Team)

A player-versus-player contest is a peer skill contest between partnered players, each of whom has installed the Rush Live companion so the result can be verified. It may be played head-to-head (1v1) or in teams of two, three or four a side (2v2, 3v3, 4v4).

  • Every participant posts an equal entry fee (ante) — no participant may enter at a different price
  • All entry fees are held in escrow and combined into a single pot
  • The winning side takes the pot minus the flat venue fee described in Fees
  • In a team contest the winning side's share is divided equally among its members
  • Rush is a neutral venue — it never picks a side, sets a line, takes a position, or contributes to the pot. The pot is funded entirely by the participants
  • The result is determined from the companion oracle on every participant's side (see Settlement, Voids and Disputed Results)
  • A challenge you post can be withdrawn, and your ante returned, at any time before another player accepts it

Contest format — what decides the winner

A contest is decided in one of two ways. Which one applies is shown on the contest before you enter, and is fixed once the contest is accepted:

  • Match result — the side that wins the match wins the contest
  • Comparative metric — the side with the higher value of a single stated in-game statistic (for example, most eliminations) wins the contest, whether or not that side won the match. The statistic is chosen from a fixed catalogue published by Rush; participants cannot define their own

A contest may also be posted as a series — best of one, three or five — in which the side that first clinches a majority of the matches wins. Series are offered only for games whose result can be verified match by match, and only for match-result contests; a comparative-metric contest is always a single match.

11 / Self-Stake Skill Contests

Self-stake is a fixed-multiplier contest of skill where you compete against an operator-set target in your own game.

  • Before you pay, you see a fixed payout multiple announced in advance (for example, hit the target and win 3x your entry)
  • You pay an entry fee, play your match, and the companion verifies the result
  • Hit the target: you win the fixed pre-announced multiple, which Rush funds and guarantees
  • Miss the target: you forfeit the entry fee
  • The multiplier is set in advance by Rush; Rush funds the fixed prize and is never a bookmaker setting odds against you
  • You may have one self-stake open at a time; a new one can be entered once the previous one has settled

How the target is set

Each self-stake offer names the game, the mode, the single in-game statistic being measured (for example, eliminations in one match), the target value, your entry fee, and the fixed multiple you win if you reach it. The target is set by Rush from your own recent verified performance in that game as reported by the companion — not from a random draw and not from any other player. All of this is shown before you pay, and none of it changes after you enter. Self-stake is offered only on games and statistics the companion can verify directly.

Minimum verified play

Because the target is priced from your own record, self-stake in a game and mode opens only after the companion has verified a minimum number of your matches in it (currently five, higher for some games). Until then the offer is shown but cannot be entered. The same rule protects other players on the player-versus-player lanes: a game account with too little verified history may be refused a money match.

12 / Membership

Rush Live may offer an optional paid membership. When membership is available, it raises the number of self-stake contests you can enter each day and the maximum entry fee per self-stake. Membership is never required to use the App, and it does not change contest odds, targets, multipliers, or the venue fee. Player-versus-player challenges have no daily limit in any tier.

  • When membership is available, the current plans, prices, daily self-stake allowances and per-stake limits are shown on the Membership screen before you buy; the allowance runs over a rolling 24-hour window and is counted by our servers
  • When membership is available it is bought through Apple in-app purchase and billed by Apple to your Apple ID. It renews automatically at the price shown until you cancel
  • If you buy a membership, you can cancel at any time in your Apple ID subscription settings; access continues to the end of the paid period, and there is no refund for the unused part of a period except where Apple grants one under its own policy
  • If you buy a membership, prices may change; Apple will notify you before a price increase takes effect and you can cancel before it does
  • When membership is available, a tier takes effect only once our servers confirm the purchase with Apple; the App shows "Activating" until then

13 / The Companion and Your Game Accounts

The Rush Live companion is desktop software, built on the OverWolf platform, that you install on your own PC. It reads your own game client and sends us signed match data. It is the only way a result reaches Rush for every supported game except Clash Royale, whose results come from Supercell’s public API using the player tag you link. The companion has no money features of any kind.

  • You may only pair the companion with your own PC and link game accounts that belong to you
  • The companion must be running and reporting for the whole of a match you have a contest on; a match it did not observe cannot settle a contest
  • You may not modify, redistribute, or run the companion on altered game files, and you may not interfere with what it reports
  • Rush does not support the Riot Games titles (League of Legends, Valorant) in any real-money lane

Assumption of risk — your game account. Running the companion alongside a game may be restricted by that game's publisher or anti-cheat system, and a publisher may warn, suspend, or permanently ban your game account at its own discretion. You install and run the companion at your own risk. Rush does not control any publisher or anti-cheat system and, to the maximum extent permitted by law, is not responsible for any action taken against your game account, progress, in-game items, or any third-party account. You are responsible for complying with each game's own terms.

14 / Settlement, Voids and Disputed Results

Contest results are determined from verified game-truth supplied by the Rush Live companion (the "companion oracle"), which observes the partnered player's own game client. Clash Royale results are sourced from the Supercell API.

  • For player-versus-player contests, the result is verified through the companion on every participant's side; entry fees are released from escrow to the winning side
  • For self-stake, the companion verifies whether you hit the operator-set target
  • If results conflict, are missing, or are disputed, Rush may hold the funds in escrow pending review and human resolution
  • Rush's settlement determination, based on the companion oracle and any independent corroboration, is final for purposes of paying out a contest

When a contest is voided

A contest is voided — and every entry fee is returned to the deposit bucket it came from — if the match never starts, if a participant's companion stops reporting before the result, if the verified data from the two sides cannot be reconciled, if the game or mode changes after entry, or if we determine the result was affected by prohibited conduct. A voided contest is not a win or a loss for anyone, and the venue fee is not charged on it.

Disputed results, unauthorized transactions, and payment errors

If you believe a result was settled wrongly, that a transaction on your wallet was not authorized by you, or that a deposit, entry fee, payout, refund, or withdrawal was recorded for the wrong amount, tell us at rushliveteam@gmail.com within 30 days of the transaction. We will review the companion data, our ledger, and Stripe's records and correct any error we find on our side. We may reverse an amount that was credited to you in error.

15 / Fair Play: Cheating and Dishonesty

Every lane is a skill contest. Conduct designed to move money rather than to compete, or to win by anything other than your own play, is strictly prohibited and may result in voided contests, withheld payouts, and account termination.

  • Chip-dumping: intentionally losing a contest to transfer value to another account
  • Collusion: coordinating contest outcomes, entries, or play with another user
  • Multi-accounting: creating or operating more than one account to gain an unfair advantage or to play yourself
  • Using the platform to launder money or to move funds rather than to compete in a contest of skill
  • Smurfing: playing on a game account whose rank or history does not reflect your real skill, or entering contests on a game account that is not yours
  • Account sharing: letting anyone else play, verify, or cash out on your Rush account or on the game account linked to it
  • Intentional underperformance: deliberately playing below your ability — in a contest or in ordinary matches — to lower the targets or pricing you are offered later, or to affect another user's contest
  • Falsifying game data: altering, spoofing, delaying, or blocking what the companion reports, or running the companion on modified game files
  • Cheats, hacks, aimbots, macros, or any third-party software that plays for you or gives you information the game does not
  • Disputing a deposit with your card issuer after using the money, or otherwise obtaining a refund you are not entitled to

Evidence and monitoring

We monitor gameplay and account activity for patterns consistent with the conduct above, and we may ask you for reasonable evidence of your gameplay — such as a recording, screenshots, or a match ID — before a result is settled or a payout is released. If you cannot or do not provide it, we may treat the contest as unverified and hold or void it.

Because contest outcomes settle real value, tampering with what the companion reports is fraud for which you may be held legally and financially liable, including repayment of any resulting payouts and indemnification of Rush Live and affected users.

16 / Prohibited Uses

The following activities are strictly prohibited and may result in immediate account termination, voided contests, and withheld payouts. You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Use the App from a restricted state, or hide where you are with a VPN, proxy, or false address
  • Harass, abuse, threaten, or harm other users or staff
  • Attempt to manipulate or exploit the contest, pricing, or settlement systems
  • Use bots, scripts, scrapers, or any automated tools to interact with the platform
  • Knowingly exploit bugs, glitches, or system errors, or fail to report one that gave you money
  • Commit fraud, money laundering, identity theft, or any fraudulent activity
  • Probe, scan, or interfere with our servers, the companion, or the security of any account
  • Reverse engineer, decompile, or attempt to extract the source code of the App or the companion
  • Impersonate Rush Live, a member of our staff, or another user

17 / User Content and Feedback

Content standards

User-generated content (usernames, profile bios, avatars, and anything else you post or send through the App) must not contain offensive, discriminatory, sexually explicit, or illegal material, must not infringe anyone’s rights, and must not impersonate another person. We reserve the right to remove content and suspend accounts that violate these standards. You are responsible for what you post.

Licence to your content

You own what you post. By posting it you give Rush Live a non-exclusive, royalty-free, worldwide licence to store, display, and reproduce it for the purpose of operating the App — for example, showing your username and avatar to the players you challenge — for as long as it is on the App.

Feedback

If you send us ideas, suggestions, or feedback about the App, you agree we may use them without any obligation to you. Feedback is not confidential.

Copyright complaints

If you believe content on the App infringes your copyright, email rushliveteam@gmail.com with the content's location, a description of the work, your contact details, and a statement made under penalty of perjury that you own the work or act for its owner. We will remove infringing content and may close the accounts of repeat infringers.

18 / Intellectual Property and Your Licence to Use the App

The App, the companion, and everything in them that is not user content — the software, design, text, graphics, logos, the Rush Live name and marks — belong to Rush Live or its licensors and are protected by copyright, trademark, and other laws. Game names and publisher marks belong to their respective owners; Rush Live is not affiliated with or endorsed by any game publisher.

  • We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App and the companion on devices you own, for your own non-commercial use, under these Terms
  • You may not copy, modify, distribute, sell, rent, or sublicense any part of the App or companion, or use them to build a competing product
  • You may not remove any copyright, trademark, or proprietary notice
  • We may release updates that change or remove features. Some updates are required for the App or companion to keep working with the games it supports, and a contest cannot settle from a companion version we no longer accept
  • Your licence ends when your account is closed or when you stop using the App

19 / Communications

  • Sign-in codes: when you sign in with a phone number we send a one-time code by SMS; with an email address, by email. Message and data rates from your carrier are your responsibility
  • Service messages: we may email or notify you about your account, contests, settlements, payouts, security, and changes to these Terms. These are part of the service and cannot be turned off while you have an account
  • Push notifications: optional. The App asks your permission, and you can turn them off in your device settings at any time
  • Marketing: we may tell you about new games, features, and promotions. You can opt out at any time, and opting out does not affect service messages

20 / Taxes

You are responsible for any taxes on amounts you win. Rush Live may report winnings to tax authorities as required by law.

  • Net winnings of $2,000 or more in a calendar year are reported on IRS Form 1099-MISC
  • You may be required to provide a valid taxpayer identification number before a reportable payout or withdrawal is released

These are skill-contest winnings, not gambling winnings; they are not reported on Form W-2G.

21 / Geographic Restrictions

Every lane in the App is played for real money. Because state laws on skill contests for money differ, the App is available in 38 U.S. states and is NOT available to residents of the 12 states listed below. This list is updated as the law changes.

Real-money lanes are unavailable to residents of, or users located in: Arizona (AZ), Arkansas (AR), Connecticut (CT), Delaware (DE), Florida (FL), Indiana (IN), Louisiana (LA), Maryland (MD), Montana (MT), South Carolina (SC), South Dakota (SD), and Tennessee (TN).

  • Your eligibility for the real-money lanes is determined by your verified state of residence
  • Attempting to circumvent these restrictions (for example, by using a VPN or false location) is prohibited
  • At each real-money action (deposit and contest entry) our servers check the state of residence on your verified identity document — or, where we allow it, the state you told us — against the restricted list, and refuse the action if the state is restricted or unknown
  • The App does not currently ask your phone for its location. We reserve the right to add geolocation and IP-based location technology to confirm where you physically are before permitting a real-money action; if we do, the App will ask for the permission and the Privacy Policy will say what is collected
  • The App is offered only in the United States. If you use it from elsewhere you do so on your own initiative and are responsible for local law

22 / Monitoring, Enforcement and Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. You may also delete your account at any time through the App settings; any withdrawable winnings and any refundable deposit balance are returned to you first, subject to the reviews below.

Investigations and enforcement

We may investigate any suspected violation of these Terms. While an investigation is open we may freeze real-money activity on your account and hold any affected payout. If we find a violation we may, depending on its seriousness, disqualify the contest entries involved, void or claw back the payouts that resulted, restrict the games or lanes you can enter, or suspend or close your account. Entry fees and winnings from contests you played fairly are not affected by a finding about a different contest.

Asking us to review a decision

If an enforcement decision changed a result, held a payout, or closed your account, you may ask for a review by emailing rushliveteam@gmail.com within 30 days, stating which contest or action you dispute and why. A person who was not involved in the original decision will review it and reply in writing. This review is separate from, and does not replace, the Dispute Resolution & Arbitration section.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

Contest outcomes are determined from verified game-truth supplied by the Rush Live companion (and the Supercell API for Clash Royale). We are not responsible for data inaccuracies or delays that may affect contest results, or for a game publisher changing or withdrawing the data the companion relies on.

Contests are between you and other players, or between you and a target. Rush Live does not vouch for any other user, and any dispute you have with another user is between you and them, except to the extent these Terms give Rush a role in settling a contest.

24 / Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUSH LIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. Nothing in this section limits our obligation to pay you money your wallet holds for your benefit.

25 / Indemnification

You agree to defend, indemnify, and hold harmless Rush Live and its officers, directors, employees, and agents from any claim, loss, liability, and expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or of a third party’s rights, your content, or any fraud or prohibited conduct on your account — including any payout obtained through it.

26 / Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Rush Live platform shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

  • Arbitration will be conducted in Delaware or your place of residence, at your election
  • The arbitrator's decision will be final and binding
  • CLASS ACTION WAIVER: You waive any right to participate in a class action lawsuit or class-wide arbitration. If this waiver is unenforceable as to a particular claim, only that claim proceeds in court and the rest of this arbitration agreement stays in effect
  • Delegation: the arbitrator (not a court) decides questions about the interpretation, enforceability, or formation of this arbitration agreement
  • This arbitration agreement is separate from the rest of these Terms and survives even if any other provision, or these Terms as a whole, is found void or unenforceable
  • Coordinated / mass filings (25 or more similar demands within 60 days) are administered under the AAA Mass Arbitration Supplementary Rules, using bellwether cases and a global mediation before further cases proceed
  • Public injunctive relief and any other non-waivable claim may be brought in court
  • 30-day opt-out: you may opt out of arbitration by emailing rushliveteam@gmail.com with "I opt out of arbitration" within 30 days of first accepting these Terms
  • Small claims court actions (under $10,000) are exempt from this arbitration requirement
  • Any claim must be brought within one (1) year after it accrues, or it is permanently barred

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

27 / General Terms

  • Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and Rush Live about the App and replace any earlier agreement
  • Severability: if any provision is found unenforceable, the rest of these Terms stay in effect (the arbitration section carries its own rule on this)
  • No waiver: our not enforcing a provision on one occasion is not a waiver of it
  • Assignment: you may not transfer these Terms or your account; we may assign them to a successor to our business, and will tell you if we do
  • Export: the App and companion are subject to U.S. export laws; you may not use or export them where U.S. law prohibits it
  • Survival: sections that by their nature should outlast your account — including Fair Play, Taxes, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution — survive its closure

Rush Live offers skill-based contests with fixed and known prizes. In the real-money lanes, outcomes are determined by player skill and verified game performance, and entry fees and prizes are disclosed before you enter. This App does NOT offer:

  • Gambling or betting against the house
  • Casino games or slots
  • Sports betting or a sportsbook on real-world events
  • Sweepstakes or games of chance

The player-versus-player lanes (1v1 and team 2v2/3v3/4v4) and the self-stake lane are contests of skill where prizes are funded and disclosed in advance, and are unavailable in restricted states. Apple Inc. is not a sponsor of and is not involved in these contests.

These Terms are between you and Rush Live, not Apple. Apple has no obligation to maintain or support the App, is not responsible for any claim about the App or your use of it, and is not responsible for investigating or resolving any third-party claim that the App infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Membership purchases are billed by Apple under its own terms.
